Procedure for establishment of an executive office of a foreign investor BCC contract

1. Manner of execution: The receipt of dossiers and return of results are done directly at the headquarters of the administrative agencies or by postal mail.

For online declaration applications, the investor shall declare information about the investment project at the National Portal of Foreign Investment and receive the online declaration code.

Within 15 days from the date of online declaration, the investor shall directly submit the dossiers to the investment registration authority.

2. Composition and number of dossiers:

    Composition of the dossiers includes:

a) Written registration of establishment of executive office including the name and address of the representative office in Vietnam (if any) of the foreign investor in BCC; name and address of executive office; content, duration and scope of activities of the executive office; full name, place of residence, ID Card/Citizen ID Card or passport of the head of executive office (Form I.5);

b) Decisions of the foreign investor in BCC on the establishment of executive office;

c) A copy of the decision to appoint the head of the executive office;

d) A copy of Business Cooperation Contract (BCC).

e) Office lease contract (if any).

Number of dossiers:  01 original set.

3. Timeline for settlement: 06 working days from the submission date if the application is valid.

4. Objects carrying out administrative procedures: Investors and organizations and individuals engaged in business investment activities

5. Implementing agency carrying out administrative procedures:

The Competent authority for making decision: Department of Planning and Investment.

The agency directly carrying out administrative procedures: Department of Planning and Investment.

6. Results of administrative procedures: 

    The operation registration certificate of the executive office.

7. Fees (if any): Not applicable.
